NR 700 Semi-Annual Reporting Due Soon

Semi-annual reporting for the period of July 1, 2018 to December 31, 2018 is due February 1, 2019. Semi-annual reporting is required of responsible parties (RPs) for all “open” sites, including those sites the DNR formerly classified as “conditionally closed” in the BRRTS online database. Consultants may submit these reports on behalf of the RPs.

An email from the DNR with your unique report identification number was sent during the first week of January 2019. If you did not receive an email, you can request a Report ID number by submitting the Report ID Request Form. The Report ID number you will receive uniquely identifies the activity for which you wish to report, the reporting period, and verifies the person using the ID is authorized to submit the report. New Document Submittal Portal for RR Program

The Remediation and Redevelopment program’s new RR Program Submittal Portal is now live and available to use.

The new portal allows consultants and other customers to submit documents required by Wis. Admin. Code chs. NR 700-754 related to the assessment, investigation, cleanup, closure, or redevelopment of contaminated properties.

NR 712 Consultant Qualification Guidance Posted

Following much collaboration and public comment, Wis. Admin. Code ch. NR 712 Qualifications and Certifications (RR-081) is now available. In addition to the guidance being available on the Remediation and Redevelopment program’s Publications and Forms search page, it can also be found on the program’s web page for Environmental Professionals.

The document identifies the professional qualifications and certifications for performing and supervising work required by Wis. Admin. Code ch. NR 712, and the requirement for certifying specific submittals for actions conducted under Wis. Stat. ch. 292 and Wis. Admin. Code chs. NR 700 – 754.

DNR Brownfields Annual Accomplishments Report Now Available

The Wisconsin DNR’s final report summarizing efforts and accomplishments funded by a US EPA Section 128(a) Grant is now complete and available online.

The report, prepared by the Remediation and Redevelopment (RR) program’s Brownfields and Outreach section, highlights the work and major accomplishments that program staff and partners achieved during the September 1, 2017 to August 31, 2018 grant year.

Previous reports, including the recent mid-year update on 128(a) funded efforts, are also available on the RR program’s website.

“Our staff put a lot of time and effort into working on brownfields cleanup and redevelopment projects and policies throughout the year. We’re proud to present this comprehensive report on those efforts and we’re grateful to the US EPA for providing funds to help us with those projects,” said Christine Haag, Brownfields and Outreach section chief.

Consultants may submit these reports on behalf of the RPs.

An email from the DNR with your unique report identification number will go out on July 2, 2018. If you do not receive an email, you can request a number by submitting the Report ID Request Form. The Report ID number you will receive uniquely identifies the activity for which you wish to report, the reporting period, and verifies the person using the ID is authorized to submit the report. Semi-annual reports are required by state law of persons who meet the definition of responsible party in NR 700. Therefore, property owners, such as local governments that have an exemption under Wis. Stats. §§292.11(9)(e) or 292.23 and lenders that have an exemption under Wis. Stats. §292.21 for specific properties are not required to submit a semi-annual report under state law for those exempt properties.

Sites formerly classified by the DNR as “conditionally closed” sites (e.g., investigative waste needs to be removed) are those that have not been granted case closure and, by definition, have remaining action(s) needed (e.g, properly abandoning monitoring wells). Semi-annual reporting for these otherwise open sites should indicate what actions are being taken to complete the remaining actions and when they’ll be taken.

This semi-annual reporting requirement replaces PECFA annual web reporting. Consultants and responsible parties were previously required to inform the agency of the progress and the estimated cost of work remaining in the investigation for PECFA-eligible sites. Now, submission of the semi-annual online form satisfies PECFA’s requirement to report progress. A separate PECFA web report is not required.

The next reporting period is from July 1, 2018 to December 31, 2018. Reports for that period will be due approximately January 31, 2019. A future RR Report will have specific details.

DNR Brownfields Report of Annual Accomplishments Now Available

The Remediation and Redevelopment Program’s annual report to the US EPA of brownfields accomplishments, which details a year-long effort of outputs and outcomes funded by a federal grant, is now available online. The Section 128(a) Grant Final Accomplishments Report, for the reporting period of September 1, 2016 to August 31, 2017, highlights work completed in the previous funding year.

The “128(a) Final Report” includes a summary of the various metrics tracked during the year (Green Team meetings, outreach activities, etc.), highlights a number of successful cleanups and redevelopments from across the state, and features a number of important program improvements undertaken during the year.

New Instructions for RR Program’s FTP Site for Electronic Submittals of Large Files

The Remediation and Redevelopment Program’s FTP site for submitting large (>12 MB) electronic files recently experienced technical difficulties. The site is back online, but with new instructions for submitting large files. Please use the following instructions.

To upload files larger than 12 MB to the regional folder on the RR FTP site:

  1. Open the following link in your browser: https://ftp.wi.gov/submittals/
  2. You will be asked for a User Name and Password
  3. Enter User Name dnr-rraccess
  4. Enter any password you want (Note: You cannot leave the Password blank)
  5. Navigate to the appropriate regional folder
  6. Use the Upload tool to load files to the ftp site

These new instructions are detailed in the guidance document RR 690, “Guidance for Electronic Submittals for the Remediation and Redevelopment Program.”

 

Reminder: Required Submittals, Consultant Qualifications and Certifications

As part of the Remediation and Redevelopment Program’s continuing outreach to its customers, the program wants to remind consultants and responsible parties that:

(1) Wis. Admin. Code § NR 700 rule series (hereafter “NR 700”) specifies the technical reports or documents that must be submitted to the Department of Natural Resources (DNR) regardless of whether the responsible party is requesting a fee review or not; and

(2) Those documents are to be prepared by or under the supervision of a professional engineer, hydrogeologist or scientist as those terms are specifically defined in NR 712.03. This rule chapter requires: (1) appropriate qualifications of the consultant; (2) signatures; and (3) certification language to be included with the appropriate NR 700 submittals.
