Public Input Opportunity: PECFA Usual and Customary Cost Schedule #27

The Remediation and Redevelopment (RR) Program seeks your input on the Usual and Customary (U&C) Task Reference Guide #27 (Publication RR 0113-E) and U&C Cost Schedule #27 (Publication RR 0113a-E). Both documents are available for review on the Wisconsin DNR’s proposed program guidance web page.

Comments on these documents are due by January 6, 2020, and may be submitted to DNRRRGuidance@wisconsin.gov. Please use the subject line: RR-19-0113-D.

Document updates include a number of items related to the investigation and mitigation of vapor intrusion, such as the reimbursement of initial installation and vapor sampling, separating out costs associated with equipment needed to install vapor sampling points, and a new subtask for subsequent vapor sampling events after initial installation and sampling.

RR Program’s PFAS Technical Advisory Group Meetings Scheduled

The DNR’s Remediation and Redevelopment (RR) Program will convene a PFAS Technical Advisory Group (TAG) to discuss PFAS-related concerns that are specific to the assessment and cleanup of environmental contamination.

The goal of the group is to examine the “what, where, when and how” of PFAS investigation and remediation by sharing concerns, identifying current and proposed practices, and strategizing on issues requiring solutions. The group does not have an appointed membership; any interested party may attend.

First Rule Development Meeting Scheduled for February 5, 2019

On February 5, 2019, the Remediation and Redevelopment (RR) program will host the first meeting in a series of public meetings to provide information and seek input on the development of revisions to select provisions of Wis. Admin. Code chs. NR 700799, Environmental Protection – Investigation and Remediation of Environmental Contamination.

The RR program is initiating the rulemaking process following the Natural Resource Board’s approval on January 23, 2019, of two statements of scope that describe the proposed content of the rulemaking.  These scope statements are available online in the Wisconsin Administrative Register.

Hold the Date: First Rule Development Meeting Tentatively Scheduled for February 5, 2019

On January 23, 2019, the Remediation and Redevelopment (RR) program will seek the approval of the Natural Resource Board (NRB) to initiate the rulemaking process for revisions to select provisions of Wis. Admin. Code chs. NR 700799, Environmental Protection – Investigation and Remediation of Environmental Contamination. If this request is approved, the RR program will host a series of open meetings to seek input on the development of the proposed rules.

Pursuant to Wisconsin’s administrative rulemaking process, the RR program has prepared two statements of scope that describe the proposed content of the rulemaking.  These scope statements are available online in the Wisconsin Administrative Register.

EPA Solicitation for 2018 BUILD Act Comments

The Brownfields Utilization, Investment and Local Development (BUILD) Act was enacted on March 23, 2018 as part of the Consolidated Appropriations Act, 2018. The BUILD Act reauthorized EPA’s Brownfields Program, and made amendments to the 2002 Small Business Liability Relief and Brownfields Revitalization Act.  Authorized changes affect brownfields grants, ownership and liability provisions, and state and tribal response programs. EPA is developing policy guidance to implement the BUILD Act.

As part of this process, the EPA is soliciting comment on three provisions in the BUILD Act:

  1. The authority to increase the per-site cleanup grant amounts to $500,000;
  2. The new multi-purpose grant authority; and
  3. The new small community assistance grant authority.

Comments will be accepted through July 10, 2018 to BUILDAct@epa.gov.

Document updates include new tasks for vapor point installation, guidance on excavations over $10,000, and an update to private utility locate reimbursable costs. Please see the public comment cover sheet for details.

Public Input Opportunity – Case Closure Reconsideration Process

The RR Program seeks your input on a revised, draft publication entitled “Wis. Admin. Code ch. NR 726 Case Closure Reconsideration Process (RR-102)”.

The purpose of this document is to provide responsible parties (RPs) with guidance on the opportunities available to engage the department to receive feedback on the adequacy of the Wis. Admin. Code chs. NR 700-754 response actions undertaken and submitted by the RP to document case closure. This guidance presents the process and feedback opportunities available if case closure is not recommended by the department. This general process is referred to as the case closure reconsideration process.

Public Input Opportunity: Variances to the Usual and Customary Standardized Invoice for PECFA Projects

The Remediation and Redevelopment (RR) Program seeks your input on guidance regarding variances to the Usual & Customary (U&C) Standardized Invoice for Petroleum Environmental Cleanup Fund Award (PECFA) Program projects.

The guidance addresses a limited number of PECFA-eligible activities, based on their common occurrence, in order to ensure consistency in approving cost reimbursement where no standard rate exists.
