Following a public comment period, the following publications are now posted and available online:

Guidance: DNR’s Superior Lien Authority and What It Means for Property Owners (RR-507)
This guidance is intended for property owners and mortgagees. It defines and explains a superior lien, which is a type of environmental lien that the Wisconsin Department of Natural Resources (DNR) places on properties when the DNR cleans up contamination on a property and is not reimbursed. A superior lien allows the DNR to recover the public funds spent on the cleanup.

Guidance: Environmental Liability Exemptions for Lenders and Representatives (RR-508)
The purpose of this guidance is to provide information to lenders and representatives about environmental liability exemptions available for sites with hazardous substance discharges to the environment.

Guidance: Post-Closure Modifications (RR-982)
The purpose of this guidance is to aid in the preparation and review of post-closure modification (PCM) submittals to the DNR. Information about the types of PCMs, the process, fees and types of responses available from the DNR is provided. This guidance is for use by property owners, responsible parties, environmental consultants and DNR staff. It is based on authority provided under Wisconsin Statutes (Wis. Stat.) § 292.12(6) and Wisconsin Administrative Code (Wis. Admin. Code) ch. NR 727.

Public Input Opportunity – Guidance: Post-Closure Modifications (RR-982)

The Remediation and Redevelopment (RR) Program is now seeking input on the publication Guidance: Post-Closure Modifications (RR-982).

The purpose of this guidance is to aid in the preparation and review of post-closure modification (PCM) submittals to the Wisconsin Department of Natural Resources (DNR). Information about the types of PCMs, the process, fees and types of responses available from the DNR is provided. This guidance is for use by property owners, responsible parties, and environmental consultants. It is based on authority provided under Wisconsin Statutes (Wis. Reminder To Use Updated Case Closure Request Form (4400-202)

The Remediation and Redevelopment (RR) Program reminds anyone submitting a case closure request that the most up to date Case Closure Request Form (4400-202) must be used per Wis. Admin. Code § NR 726.09(1). This form was last updated in October 2022 to clarify database fees and provide information on electronic submittals.

The current form can be found online, or by visiting dnr.wi.gov, search “4400-202.” Please avoid using any desktop versions that you may have saved. A case closure request may be considered incomplete if submitted on an obsolete form.

The Wisconsin Department of Natural Resources suspended the requirement to submit a paper copy of the closure request form and supporting documentation. Customers are strongly encouraged to submit documents via the online Submittal Portal. Please refer to Guidance for Submitting Documents (RR-690) for additional information on the format and procedures for submitting documents to the RR Program.

Issues & Trends Webinar on April 12, 2023: Ready For Reuse Revolving Loan Funds Program

The Remediation and Redevelopment (RR) Program’s next webinar in the Issues & Trends series will take place on Wednesday, April 12, 2023, from noon-1 p.m.

The scheduled presentation is the Ready for Reuse (RFR) Revolving Loan Funds Program.

The webinar will focus on the variety of ways to use RFR during the post-closure and redevelopment stage, as well as during the cleanup process. A question-and-answer session will follow the presentation.

RFR loans are used for environmental cleanup of hazardous substances or petroleum at brownfields throughout Wisconsin. Learn more about RFR on the RR Program Wisconsin Ready For Reuse webpage.

Updated Case Closure Request Form (4400-202) Available

The Remediation and Redevelopment (RR) Program updated its Case Closure Request Form 4400-202 to clarify under which circumstances Wisconsin Administrative (Wis. Admin.) Code ch. NR 749 database fees should be submitted and to provide updated information regarding electronic submittals.

The updates only affect page 1; no other changes were made to the form. Anyone submitting a new case closure request must use the updated form per Wis. Admin. Code § NR 726.09(1). If you previously submitted a case closure request with the correct fee, you do not need to provide an updated page 1 with a resubmittal. Please contact the regional team supervisor if you have questions regarding your case closure request.

Public Input Opportunity Ends Soon for Publication RR-606, Guidance on the Case Closure Process and Continuing Obligations: Wis. Admin. Code chs. NR 725 to727

The public comment period ends next week (March 24, 2021) for publication RR-606, Guidance on the Case Closure Process and Continuing Obligations: Wis. Admin. Code chs. NR 725 to 727.

The purpose of the guidance is to guide users in preparing for a case closure request, particularly at sites where contamination remains after response actions are complete and continuing obligations are needed to address exposure pathways. This guidance document is intended for use by responsible parties, consultants or other interested parties, the Wisconsin Department of Natural Resources staff and Wisconsin Department of Agriculture, Trade and Consumer Protection staff.

Reminder: Submittal Portal Redesign; Unavailable Jan. 3 (5:00 p.m.) to Jan. 7 (9:00 a.m.)

The Remediation and Redevelopment (RR) Program reminds you that the Program’s Submittal Portal will go offline beginning today, January 3, at 5:00 p.m. until Tuesday, January 7 at 9:00 a.m.

The RR Program will launch an updated submittal portal at that time. The URL to the application will be slightly different and the new link will be updated on the RR Program Submittal Portal website on the morning of January 7.
